Regulatory basis and implementation time
Legal basis: Export Control Law of the People’s Republic of China, Foreign Trade Law, Customs Law, Regulations on Export Control of Dual Use Items, etc.
Announcement number: Announcement No. 56 of 2025 by the Ministry of Commerce and the General Administration of Customs.
Effective date: officially implemented from November 8, 2025
Current status: According to the consensus of China US economic and trade consultations, this regulatory measure will be temporarily suspended until November 10, 2026
List of Regulated Rare Earth Extractants
The following five extractants are included in the scope of export control and require a license for export:
P507:2-Ethylhexyl phosphonic acid mono-2-ethylhexyl ester (CAS 14802-03-0), reference tariff code column: 29319000
P204: Di (2-ethylhexyl) phosphate ester (CAS 298-07-7), reference tariff code column: 29199000
Cycloalkanoic acid (CAS 1338-24-5), reference tariff code column: 38249999
N235: Trioctyldecane tertiary amine (CAS 68814-95-9), reference tariff code column: 38249999
C272: Bis (2,4,4-trimethylpentyl) phosphonic acid (CAS 83411-71-6)
Export compliance requirements for the suspension period of export controls on some rare earth extractants:
Export operators must indicate in the remarks column of the customs declaration whether it belongs to “dual-use items” and the corresponding export control code.
If the product parameters are close to the control standards but do not belong to the controlled items, it is also necessary to indicate “not belonging to the controlled items” in the remarks column and fill in the specific parameters.
Customs will suspend the release of goods with inaccurate or questionable information.
Customers with demand are requested to purchase as soon as possible.
